In that case the other party may declare a breach and seek remedies without waiting for the actual breach to occur. The legal remedy for a breach of contract is money damages. No damages, no lawsuit. The party claiming damages must first mitigate damages. The party must take reasonable steps to cap or lessen the damages. If nothing can be done to reasonably mitigate the damages then there is no requirement to do so. The damages are only those that would make the party whole.
